1. ACCEPTANCE OF TERMSBy accessing this website, submitting your information, purchasing services, or engaging with Van Media (“Company,” “we,” “us”), you agree to be bound by these Terms of Use.If a separate written agreement or contract is signed between you (“Client”) and Van Media, those terms will apply in addition to these Terms. If no separate contract is signed, these Terms of Use serve as the full and binding agreement between both parties.If you do not agree to these Terms, you must not use our services.
2. SERVICES PROVIDEDVan Media agrees to:- Set up and launch a custom-built Facebook (Meta) advertising campaign
- Provide access to a CRM system for organizing and tracking leads
- Deliver leads to the Client in real time through automated or manual systems
- Provide basic follow-up structure, documentation, and consultation if neededVan Media does NOT:
- Perform sales on behalf of the Client
- Guarantee closed deals or revenue outcomes beyond the stated guarantee termsThe Client is solely responsible for contacting, following up with, and closing leads.
3. CLIENT RESPONSIBILITIESTo receive results and remain eligible for guarantees, the Client agrees to:- Complete an onboarding call within 10 days of purchase
- Respond promptly during onboarding and campaign setup
- Actively contact and follow up with leads provided
- Use reasonable effort to convert leads (calls, texts, emails)
- Maintain professional communication and cooperationFailure to cooperate, delays, ghosting, refusal to follow instructions, or lack of follow-up may result in:
- Reduced performance
- Voiding of any guarantee or refund eligibility
4. FEES AND PAYMENT- Service Fee: $500 USD upfront (required before campaign setup)
- Monthly Fee: $500 USD billed month-to-month
- Ad Spend: Paid directly by the Client to advertising platforms (e.g. Meta)Payments are collected via payment links or methods provided by Van Media (including Wise or other agreed methods).All fees are non-refundable except where explicitly covered under the guarantee section.
5. GUARANTEE AND REFUND POLICYVan Media offers a conditional guarantee for the FIRST service period only.A refund of the $500 service fee will be issued ONLY if ALL conditions below are met:A. Break-Even Definition
Client must NOT generate gross revenue equal to or greater than:
- Total ad spend + $500 service feeB. Required Campaign Conditions
To qualify, the Client MUST:- Run ads for a minimum of 30 consecutive days
- Maintain minimum daily ad spend:
- USA: $30/day
- UK: £20/day
- Canada: $40 CAD/day
- Australia: $30 AUD/day- Total ad spend must equal at least:
(daily minimum × 30 days)- Not pause campaigns prematurely
- Not revoke Van Media’s access during the campaign periodC. Lead Handling Requirements
Client must demonstrate good-faith effort by providing:- Proof of contact attempts to at least 80% of leads
- Call logs, screenshots, or CRM records
- Evidence of follow-up via text/email
- Proof leads were not ignoredD. Revenue Proof
Client must provide documentation proving that:- Revenue generated from leads provided by Van Media
- Is LESS than total ad spend + service feeE. Refund Request Deadline
- Must be submitted within 35 days of initial payment
- Requests after this period will NOT be consideredF. Disqualifications
The guarantee becomes VOID if:- Client fails onboarding requirements
- Client fails to follow up properly
- Client stops ads early
- Client interferes with campaign performance
- Client fails to provide required documentation
6. TERM AND CANCELLATION- Services are month-to-month
- Either party may cancel before the next billing cycle with written notice
- No refunds are issued for partial months
- No refunds if onboarding is incomplete due to Client inaction
7. ACCESS AND PLATFORM PERMISSIONSClient agrees to provide Van Media with necessary access to:- Facebook Business Manager
- Advertising accounts
- Business pagesThis access is used strictly for campaign setup, management, and optimization.Van Media will not make unauthorized or harmful changes.
8. INTELLECTUAL PROPERTYAll materials created by Van Media remain the sole property of Van Media, including:- Ad creatives
- Copywriting
- Campaign structures
- Targeting strategies
- Frameworks and systemsClient may NOT:
- Copy
- Reuse
- Distribute
- Replicateany materials without written permission.Upon termination, Van Media reserves the right to:
- Stop campaigns immediately
- Remove or delete all created assets
9. CONFIDENTIALITYBoth parties agree to keep all business, operational, and customer information confidential and not disclose it to third parties.
10. LIMITATION OF LIABILITYVan Media is not responsible for:- Client’s inability to close leads
- Sales performance
- External platform issues (Meta, etc.)
- Market conditionsAll services are provided on a best-effort basis.
11. DISPUTES AND CHARGEBACKSAll disputes must be addressed directly with Van Media before initiating any chargeback.Filing a chargeback without valid cause, while services have been delivered, constitutes a breach of these Terms.Van Media reserves the right to:- Submit all evidence (including this agreement)
- Pursue recovery of funds
- Report fraudulent disputesThese Terms serve as binding evidence of agreement upon purchase.
12. GOVERNING LAWThese Terms are governed by and interpreted under the laws of the United States.
13. ENTIRE AGREEMENTThese Terms constitute the full agreement between the Client and Van Media.They override any prior discussions, messages, or informal agreements.Any modifications must be made in writing and agreed upon by both parties.
